This privacy policy is designed to provide you with information on when we collect what data in the context of tenancies, how we process your data and what rights you have in connection with the processing of your data by us.

1. Collection of personal data

We process personal data provided by you (hereinafter referred to as “data”), including the following:

  • information concerning you as an individual and third parties living in the same household as you, as well as contact details: in particular name, date of birth, nationality, gender, address, telephone number, email address,
  • information on the bank account details for the rent deposit account and for the settlement of subsequent rent payments (e.g. account number),
  • details about your family and financial situation (e.g. number of people in the same household),
  • other information that is relevant to the contractual relationship (e.g. tenancy start date).

We can obtain information that is relevant to the conclusion and/or performance of the contractual relationship from third parties (e.g. providers of credit rating and financial information, debt collection registers, employers) – in accordance with section 2 below.

2. Purposes of the data processing

Your data will be used by us for purposes which we pointed out to you on their collection or if we are obliged to do so by law.

Baloise processes your data to the extent that this is required for the conclusion and/or performance of the contractual relationship.

In order to safeguard our legitimate interests, Baloise can also use your data as follows:

  • in order to obtain information that is relevant to the conclusion and/or performance of the contractual relationship from third parties (e.g. providers of credit rating and financial information, debt collection registers, employers),
  • within the context of real estate portfolio and asset management at Baloise; in this respect, our legitimate interest is to ensure the smooth management of our real estate portfolio (e.g. preparation of analyses).

3. Dissemination of data to third parties

Within the context of the purposes referred to under section 2, we can disseminate your data to real estate service providers and other commissioned third parties in Switzerland and abroad. Our service providers are also contractually obliged to adhere to the defined purposes of the data processing, as well as to the applicable statutory data protection provisions. In the case of service providers located in a country whose data protection legislation is assessed to be inadequate by the responsible supervisory authorities, we impose obligations on these providers by means of the standard EU contractual clauses introduced by the European Commission and recognised by the Federal Data Protection and Information Commissioner (FDPIC) prior to transferring any of your data in order to guarantee adequate protection.

In order to fulfil statutory requirements, we may be obliged to process your data and transfer it to other third parties (e.g. at the request of the authorities).

In order to obtain information that is relevant to the conclusion and performance of the contractual relationship pursuant to section 2 above, we can pass your data on to information providers (e.g. providers of credit rating and financial information, debt collection registers, employers).

Jointly with other companies, we participate in a network for the updating of addresses. As part of this, we transmit your updated address details to a service provider for address updating purposes. This service provider only transfers the updated address to other companies within the network that also have a customer relationship with you. There is no sale or trading of addresses involved in this process. In this respect, our legitimate interest is that we and other affiliated companies with whom you have a customer relationship can reach you at any time and thereby ensure more efficient communication with you.

Your data may also be shared for the aforementioned purposes with other recipients (e.g. experts and appraisers, Baloise business partners, parties involved in legal proceedings or acquirers of business units of Baloise). These recipients will always be required to comply with the applicable data protection provisions.

4. Your rights in relation to your data

If you wish to receive information about your personal data that is processed by us, you can do so by submitting to us your written request for information with an enclosed copy of your identity card or passport.

You can request that we rectify inaccurate data or complete data that is incomplete, that we restrict the processing of your data and, in certain cases, that we transfer your data to another entity. You may also demand the deletion of your data, provided we are not required or authorised by applicable law or regulations to retain your data.

You have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data if the processing takes place to safeguard our legitimate interests. If you object, we shall no longer process your personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

In all cases in which the data processing is based on your consent, you have the right to revoke this at any time. If you revoke your consent, this does not affect the legality of the processing undertaken on the basis of your consent up until the revocation.

In addition, you have the right to make a complaint to the responsible data protection supervisory authority in the case of a violation of your rights.

5. Retention period

In accordance with our erasure policies, your data will only be stored by us for as long as this is required for the aforementioned purposes or longer if we are authorised or legally obliged to store it for a longer period.

6. Obligation to provide data

As part of the contractual relationship, you have to provide us with the personal data that is required for the conclusion and performance of the contractual relationship or which we are legally obliged to collect. Without this data, we will generally not be able to conclude or perform the agreement with you.

7. Changes to this information on data processing

We reserve the right to amend or supplement this information on data processing at any time. We will inform you of any amendment to this information on data processing in an appropriate manner (e.g. on our website) before the change comes into effect.
